you are nobody to the middle vendor and he has no contract or anything with you. Whether he pays your employer or not is none of your business... it is for those two to figure out.
Legally your employer has to pay you whether he is getting paid or not. If you want that $$$ complain against your employer before he closes the shop and files bankruptcy.

My salary in 2011 has been raised by $20K per annum, from what it was in 2010.
Will this have any consequences on my next H-1B renewal OR if i go for visa stamping OR on the PERM application?
Mine is a small company with just 12 employees and I hold the same position as I used to when i sarted. I just want to know if there would be any issues with this on any stages.
Your replies would be appreciated.
It's no problem at all if you make exactly the same amount as mentioned on your H1B petition or if you make more than that. It never is an issue to make more $$$$$$. Make hay while the sun shines.:D

You can have a contract written for the required 5 yr period, where you and the employer have a without cause 60 or 90 day opt out clause. Many contracts are structured that way and there have not been problems previously. The main thing is the letter that comes form the State Dep't of heath supporting your petition. Speak with the point person in your state and they will be able to guide you.
Generally it is less complicated to get an employment contract for the NIW commitment duration, however in answer to your question, yes you can also petition on a business plan to open a practice after your 3 yr commitment. The visa retrogression and inability to file 485 may complicate this a little however.
Another distinction you should understand is, once you get an employment agreement, the petition can be filed by your employer or by you. You should self petition since you then control the destiny of the 140 petition. ie. it will not be withdrawn.

Had a quick question. Not sure if this has been discussed before. Planning to get wife here on H4 and she wants to study. I have applied for 485 and in retro now. Is it advisable to study on H4 or F1? I know she can work on F1 but would that not be advisable since lets say the VB does become current in future for me then filing her 485 might be a problem since F1 is pure non immigrant and USCIS might hold it againt her. Any info/simlar situations greatly appreciated.

1. Would there be any adverse effect if in future Company B files H1B for me ?
2. What generally happens if I file H1B and am not able to attend the interview ?
3. Is there any way Company A can revoke the H1B petition after I resign before H1B interview ?

You message is not clear. Are you saying he cannot work without getting a new H1. If he needs to get a new H1, then he needs to go out of the country for more than a year and come back later with a new H1.
I beleive, he can do H1 transfer. By the way, the new company should also start your labor and I140. Still you can port your PD if you have already 140 approved.

You should get your EAD after FP
Not true... FP depends on your local office... If they are backlogged then your FP is delayed.. So if you are from BA/NY/NJ your FP will be delayed... As far as EAD is concerned you just have to wait... Its very unpredicatible... I got my EAD 1 month AFTER I got my gc! go figure!! My wife received hers last week.. BTW I am a early June filer

Could you please pm us the IP address of your machine. It will help us to diagnose the problem and/or let you know the reason. Its possible that your work environment is using NATing. So all machines from within that network will propagate the same external IP address. If you could send us your IP address at work, we will be able to diagnose the problem.
